Terms of use
These terms govern the use of Tably. They set out what we commit to, what we ask you not to do, and what happens to your data when you leave. We have tried to write them so they can actually be read.
Who the agreement is between
Tably is an online service available at tably.works. Its publisher can be reached at pro@tably.works. The service is hosted by ARYK SAS, in France.
The agreement is made with the company that opens a workspace, not with each of its employees. People invited to a workspace accept these terms by signing in to it.
What Tably does
Tably is an online workspace. It lets a company bring its teams together, publish internal announcements, track tasks on boards and a calendar, exchange private messages, and optionally connect a personal Google Calendar.
The service evolves. Features are added, others are changed. We will not remove an essential feature without notifying you in advance.
Your account
- An account is personal. You do not share it, and you are responsible for what is done under your identity.
- Choose a password that is not used anywhere else. If you suspect it has leaked, change it and let us know.
- Roles — owner, administrator, manager, employee — determine what each person can do. No one can act on a person of equal or higher rank.
What you agree not to do
- Upload unlawful content, or content that infringes the rights of a third party.
- Try to access a workspace, board or conversation you are not a member of, or bypass access controls.
- Disrupt the service: mass automated sending, bursts of sign-in attempts, probing for vulnerabilities without our written consent.
- Use Tably to monitor your employees' private conversations. The tool does not allow it, and that is not an oversight.
If you discover a security vulnerability, write to us rather than exploiting it. A disclosure made in good faith and without harm will not lead to any action on our part.
Your content belongs to you
Everything your company uploads to Tably remains its property. We acquire no rights to it, we do not exploit it, we do not use it to train a model, and we do not share it with anyone — except when required by an authority we are legally bound to answer.
We hold only the rights strictly necessary to host this content, display it to those who have access, and back it up.
The Tably software, brand and interface, however, remain our property. Your subscription gives you a right of use, not a right over the product.
Subscription and payment
- The subscription is monthly, priced at €19.99 for the Essential plan, €49.99 for the Team plan and €99.99 for the Group plan. The commitment is one month, or twelve months with a 15% discount.
- Payment is processed by Stripe. Your bank details are entered on Stripe and never pass through our servers.
- If a payment fails, we notify you before any suspension and give you time to settle. A suspended workspace is not deleted: its data stays in place.
- Prices may change. A price change is announced in advance and never applies to a period already paid for.
As this is a contract between businesses, the fourteen-day withdrawal right granted to consumers does not apply.
However, your first payment is refunded on request within 14 days, and a billing error always is. The details are in the refund policy.
Service availability
We do everything we can to keep Tably available, without committing to a specific uptime figure. Planned maintenance is announced in advance, and unplanned interruptions are handled at the least disruptive times.
We back up the database regularly. Backups are used to restore the service after an incident; they do not replace your own exports.
Liability
We are liable for direct damage caused by a failure on our part. Our liability is capped at the amount you paid us during the twelve months preceding the event giving rise to the claim.
We are not liable for indirect damage — loss of revenue, loss of customers, reputational harm — nor for the consequences of content you uploaded, a password you allowed to leak, or an outage of a third-party service your own depends on.
None of these limits apply in cases of gross negligence, fraud, or bodily injury.
Personal data
What we collect, why, for how long and who can read it is described in our privacy policy, which forms an integral part of these terms.
End of the agreement, and what happens to your data
You can cancel at any time from the billing page; cancellation takes effect at the end of the current period, or at the end of the commitment if one remains.
We may suspend a workspace in the event of a serious breach of section 4, after notifying you and giving you time to remedy it — unless the breach endangers the service or other users.
After a workspace is closed, you have thirty days to request a copy of your data. After that, it is deleted from our servers and our backups.
Changes to these terms
We may change this text. Any significant change is announced before it takes effect. If you don't accept it, you can cancel free of charge before that date.
Governing law
These terms are governed by French law. In the event of a disagreement, we will first seek an amicable solution; failing that, the dispute will be brought before the competent French courts.
